  1. Introduction

This agreement ("Terms") constitutes a legally binding agreement between you ("you" or "User") and Firesms Company "Africa Code Foundry" ("we" or "Company") governing your access and use of the SMS API ("API") services offered by the Company through the website located at https://firesms.co (opens in a new tab). By accessing or using the API, you agree to be bound by these Terms. If you do not agree to all of these Terms, you are not permitted to access or use the API.

  1. Definitions

"API Key": A unique identifier used to authenticate your access to the API. "Credits": Units representing the cost of sending SMS messages through the API. "Content": Any information, data, or materials transmitted through the API, including but not limited to the message body, sender name, and recipient phone number. "User Account": An account on the website required to access and use the API. 3. User Account

You must be at least 18 years old and have the legal capacity to enter into this Agreement. You are responsible for maintaining the confidentiality of your User Account information and are fully responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your User Account or any other security breach. 4. Use of the API

You agree to use the API only for lawful purposes and in accordance with all applicable laws and regulations. You are prohibited from using the API for any of the following: Sending spam or unsolicited messages. Sending messages that are false, misleading, fraudulent, or abusive. Sending messages that violate the privacy rights of others. Interfering with or disrupting the API or any other services offered by the Company. You are solely responsible for the Content you transmit through the API and agree to indemnify and hold harmless the Company from any and all claims, damages, and expenses arising from your use of the API. 5. Fees and Payment

Access to and use of the API requires the purchase of Credits. Prices, plans, and credit packages are subject to change at any time. You are responsible for all applicable taxes and fees associated with your use of the API. Refunds are not available for used Credits. 6. Intellectual Property

The API and all related intellectual property rights are owned by the Company. You are granted a non-exclusive, non-transferable, revocable license to use the API only in accordance with these Terms. 7. Term and Termination

This Agreement is effective until terminated by you or the Company. We may terminate this Agreement at any time and for any reason, with or without notice. Upon termination of this Agreement, your access to the API will be suspended, and your User Account will be deactivated. 8. Disclaimers and Warranties

THE API IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE API WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THAT THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE API WILL BE ACCURATE OR RELIABLE. 9. Limitation of Liability

IN NO EVENT WILL WE BE LIABLE FOR ANY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE API, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 10. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of Lesotho. Any dispute arising out of or relating to this Agreement shall be settled by Arbitration/Mediation/Courts of Lesotho. 11. Miscellaneous
